Select Committee created upon the resignation of Rufus Choate from the Board of Regents to investigate whether the Smithsonian was being administrated according to law. Examined both the will of James Smithson and the organic act creating the Smithsonian. Charles W. Upham recommended that no legislative action be taken at this time, but that the compromise of 1847, which required that the Institution's funds be divided between active operations and a museum and library, be reinstated. He also suggested that the Smithsonian be divided into two parts - the active operations headed by a secretary and the museum and library headed by a librarian.
