PrintAction brought by plaintiffs to enjoin defendants from demolishing a certain building located in area entered in National Register of Historical places. The defendants motioned to dismissed on lack of subject jurisdiction. Court held that because it has jurisdiction over the activities of the Federal Deposit Insurance Corporation (FDIC), and the First Bank of Dundee needed permission from FDIC to relocate, the court also has the power to enjoin the First Bank of Dundee (and other such nonfederal entities) from performing activities in contravention of federal acts, such as the National Environmental Policy Act and the National Historical Preservation Act. The Court, however, held that the Village of West Dundee had no obligation under federal acts, such as the National Historical Preservation Act, because such organization had no significant federal involvement. Motion to dismiss granted to Village of West Dundee and denied to First Bank of Dundee.
