Summary

Action to enjoin construction of penal facility in area containing historic places. Previous District Court ruling denied injunction and the Court of Appeals affirmed in part, reversed in part, and remanded. On remand, the District Court held that state had employed an impermissible bookkeeping shift in order to enjoy federal benefits without meeting statutory requirements. Court also held that state department of welfare and institution had power to withdraw its request for federal funds and to build the facility without complying with National Environmental Policy Act and National Historic Preservation Act.
