PrintPlaintiff brought suit challenging regulation of United States Department of Agriculture (USDA) that failed to include birds, rats, and mice as "animals" within meaning of Federal laboratory Animal Welfare Act. Court ruled that 1) the Department's failure to include birds, rats and mice as "animals" protected by the Act was arbitrary and capricious, and 2) Department's refusal to institute rule making proceedings was arbitrary and capricious. The court granted plaintiff's motion, and ordered the USDA to reconsider its arbitrary and capricious denial of the plaintiffs' rulemaking petition.
