Summary

Judicial consideration of whether an official of the Smithsonian has immunity from liability as an officer of a government agency, and whether this officer was acting within the perimeter of his responsibilities to the government agency. Majority ruled based on Supreme Court decision in Barr v. Matteo that the Smithsonian Institution qualifies for immunity as a "federal agency" due to its function as a "national museum and center of scholarship." Therefore, its employees are employees of the government, and have immunity as acting officers of a government agency.
