PrintUpheld earlier District Court decision that the Smithsonian did not violate the First Amendment by presenting an exhibition on evolution. The court maintained that the Smithsonian's action in presenting exhibits on evolution did not constitute an establishment of a religion, secular humanism or otherwise; and the Smithsonian's action fell with in the statutory language of the act creating the Smithsonian.
