Summary

Appelle Cotton sought attorney fees after taking motions against the Smithsonian to obtain documents under the Freedom of Information Act (FOIA). District Court awarded fees. The appeals court reversed the award of attorney's fees to plaintiff Cotton. Upheld Smithsonian's argument that it was not an agency subject to FOIA, and hence not liable for plaintiff's attorney fees.
