Summary

Court denied motion to reconsider the Court's earlier March 18, 1992 decision against the Defendant. 1) Upheld earlier decision that the Smithsonian Institution is subject to the Freedom of Information Act (FOIA) as an agency that performs government functions, responsible for safekeeping and maintaining national treasurers. 2) Denied defendant's motion to withhold documents on the basis of FOIA Exemption 7(C) because the documents in question were not compiled for law enforcement purposes. 3) Court granted the Defendant's Motion for Summary Judgment on the basis of FOIA Exemption 6, concluding that privacy interest outweighed public interest in the release of the documents.
